Eskom gave notice on 29 June 2018 that they would cut off power supply to Musina, due to the fact that the municipality is in breach of settling escalating debt to Eskom. Sakeliga has brought an urgent court application to prevent Eskom from proceeding with its decision. In response, Eskom withdrew their decisions to cut off the electricity supply to Musina.
This victory played an important role in preventing Eskom from holding paying end users hostage to force defaulting municipalities to settle their debts. This case also paved the way for Sakeliga’s participation in the Resillient case, in which legal precedent was established that paying end users may not be held hostage so that intergovernmental disputes can be resolved.
